Terms and Conditions

Parties.

In this agreement you are the “Client”, being the person or entity contracting the services of Crisp Webdesign. “We” Crisp Webdesign.

 

Work Order.

A work order in the form of an invoice shall be considered a contractual agreement between the parties. A work order submitted by email, mail or fax shall be deemed a written contract for services. A work order submitted by telephone shall be deemed a verbal contract for services. By submitting a work order, the Client acknowledges that he or she is age 18 or older and, if the Client is a business, that the person submitting the order has the authority to enter into contractual agreements on behalf of the company.

 

Services.

Crisp Webdesign provides design, development and hosting service. Our services include web site design; graphic editing; flyer, letterhead, booklet, and logo design; e-commerce design; search engine optimization and other related services. We shall not be liable for any costs incurred, compensation or loss of earnings due to the unavailability of the site, its servers, software or any material provided by its agents.

 

Bugs and Errors.

You shall test applications and programming related to your site before making it available to the public. If an error is found, Crisp Webdesign shall fix the error. However, once made available to the public, Crisp Webdesign shall not be responsible for any errors nor for any losses incurred due to malfunction. Crisp Webdesign is not responsible for any errors in the scripts or programs.

 

Use of Copyrighted Material.

We shall not be liable for and you agree to indemnify Crisp Webdesign for any copyright infringements caused by materials you submitted. We reserve the right to refuse any copyrighted material unless proof is given of permission to use such material. We further reserve the right to refuse to handle material which we deem may be offensive or illegal.

 

Payment.

A nonrefundable deposit of 50% is required before any design work will be carried out. Crisp Webdesign may require a higher deposit for websites of an adult nature. Once a deposit is paid and work completed you are obliged to pay the balance in full within ten days. If accounts are not settled, Crisp Webdesign reserves the right to pursue legal action; to add all costs of collection and legal action to your accounts; and, if providing hosting services, to remove web pages and to deny access to the website. Your sole remedy for breach of contract shall be the return of the contract amount actually paid to Crisp Webdesign.

 

Property of Crisp Webdesign.

Scripts, cgi applications, php scripts, or software written by Crisp Webdesign shall remain the copyright of Crisp Webdesign. The website designed for you, all graphics and any programming code remain the property of Crisp Webdesign until your account has been paid in full.
